you may never use my artwork for NFT or AI. Ever. period.

• by purchasing my services, you automatically agree to my terms of service
• i have the right to terminate the commission without giving a refund. this is for services rendered and time lost.

• general guidelines

• please keep open, polite, and civil communication at all times.
• all payments are required to be in United States Dollars (USD).
• if at any point you become belligerent, overly sexual, or disrespectful all communication will cease.
• stating this again : i do not give refunds.
• i do not work for minors. period.
• my ‘no’ list fluctuates. please just DM me with your idea beforehand and we’ll discuss if i’m comfortable with it!
• you do not have the right to tell me if i can or cannot post a work-in-progress of your piece unless you sign an NDA or privacy agreement.

• NDA & Privacy

• you must be upfront about NDA and privacy requirements before payment.
• i reserve the right to charge a fee for this.
• the fee will be no more than 75% of the overall total of your commission but no less than 25% depending on the size of the project.
• no WIP or assets will be posted to any platform by the artist or the client.
• all custom pngtuber/vtuber model designs are subject to NDA for privacy depending upon your debut.

(ie : original character designs and vtuber personas)• i reserve the right to refuse service without reimbursement. you may not repost, crop, edit, or redistribute works i create for you, ‘the client’. any work or any portion thereof may not be used in any manner whatsoever without the express permission of me, ‘the creator’. this includes but is not limited to : reposting cropped pieces on social media or video hosting apps. you may never use my artwork to mint an NFT or use it in AI programs.• expanding on AI - clients shall not reproduce and or otherwise use any illustration or model, etc. for the purposes of training artificial intelligence technologies to generate works in the same or similar styles or genre as the illustration or model, etc. no client may sublicense another person or persons to reproduce and or otherwise use an illustration or model, etc. for the purpose of training artificial intelligence technologies to generate work.• all characters and personages used in fanart belongs to their respective companites and/or owners. no infringement is intended.

• you are expected to read the terms of service and understand pricing before you commission me.
• you will provide at least three (3) references with descriptions and a color palette.
• with permission you may display the finished work on external sites with visible credit linked back to me. you may also use the work for personal use such as avatars/pfps, phone or computer wallpapers, and personal websites (like carrd, etc.) you must always link credit back to me if you post publicly on social media.
• you may not display my artwork in a personal gallery claiming it as your own.
• you may not use my works with the intent to redistribute for external projects, commercial or non-commercial, without permission.
• you may not change, modify, edit, or crop my artwork for use on TikTok, Youtube, or Meta owned social media apps without express permission.
• artworks for original characters and/or personas are subject to commercial fees depending upon usage.

• commercial usage

• all commissions are subject to inquiries of use whether private or public.
• commercial license and use fees will be no more than 75% of your overall total of the commission.
• any original character and/or persona is subject to commercial license fees.
• you are given ‘rights to use’. this is not a copyright. i always keep the copyrights over my artwork.
• any project can incur a commercial license fee if it is suspected you will be using it for ‘financial gains’.
• commercial use includes but is not limited to : printing with the intention to sell or make merchandise, use in/for streaming work, emotes/emoji behind paywalls, vtuber/pngtuber designs and/or assets for social media and/or streaming work.
• this policy includes using my artwork for posts on patreon. you may not use my artwork behind paywalls without express permission and without paying fees.
• this policy is subject to change at any time without notice.

• as the artist

• i reserve all rights to post on whatever social media platforms i wish unless otherwise discussed.
• all artwork, finished or unfinished, can be used in my portfolio unless otherwise discussed.
• you will never receive a sketch from me without my watermark. due to AI programs and the use of sketches to ‘train it’, i no longer offer these types of works.
• i reserve the right to refuse service or terminate a commission based on lack of communication. (please see the policy for more details)
• if you lack references, details, or color palettes : these can be provided at additional cost.
• to reiterate once more : i reserve the right to terminate the commission without giving a refund for services rendered and time lost.
• you will never receive a refund from me. ever. period. regardless of circumstances.
• you may also never initiate a chargeback; doing so is against my terms of service as i have reiterated several times that i do not give refunds.
• you will also never receive photoshop files from me.
• you will not receive physical goods from me ever unless discussed and paid for.
• i reserve the right at all times to refuse completion of a project based on giving misleading or false information with the intention to circumvent paying my labor and/or commercial license fees.

• ordering & payment info

• i take commission through twitter DM, e-mail, and Discord messages.
• when i accept your message and/or reply you have three (3) days to reply before i move you places in my queue.
• ordering is no longer first come, first serve. it is by detail of idea, detail of project, and completion time.
• all communication exchanges must be in english.
• you must have all information ready to be presented or inform me that you would like me to take control over composition, colors, etc.
• in order to compensate for fees and taxes, i have a ‘labor cost’ that is no more than $20-$60 USD depending upon the size of your project.
• all changes (from extreme detail, color palette, pose, etc.) will be discussed and finalized before payment and sketching.
• you may only request five (5) revisions to your overall commission. be it changes to pose, colors, outfits, etc. once you have used all of these revisions, you will need to pay an ‘alteration fee’.
• (for the moment) all orders will be paid for using paypal invoice. this must be paid within three (3) days or you forfeit your commission slot and/or may be pushed to the back of the line.
• please do not pay for your commission with a ‘shared’ paypal account. i am not responsible for use of a shared account and you will not receive a refund if your paypal partner proceeds to do a chargeback.
• you are buying ‘digital goods’ from me. i am not and never will be required to send anything physical to you unless agreed upon.
• filing a chargeback when my policy states i give no refunds will result in immediate blocking and blacklisting.

• Work speed & completion

• i require 100% payment upfront.
• i reserve the right to take up to two (2) weeks to begin your project.
• it can take anywhere from two (2) weeks to several months to complete a project depending upon my workload.
• if you feel your project is being delayed, please reach out to me following my communication guidelines.
• if you send a message implying that you need the artwork ‘faster’, completion of the commission will halt until a ‘rush fee’ is paid. if you refuse to pay this fee while insisting on project completion you forfeit your commission and any payment will be kept for services rendered and time lost.

• queue & deadlines

• my TAT (turn-around-time) varies by project. you will be informed of your place on my schedule when you communicate with me.
• • my business hours are Monday through Friday from 10AM to 5PM CST. this is subject to changes without notice.
• • my initial response time is between three to five (3-5) days. if i don’t reply after five days, please reach out the next business day.
• • a deadline can be no shorter than ten (10) business days. a ‘rush order’ is subject to a fee of no less than 150% of the total commission price including other fees.
• • i reserve the right to decline a project based upon ‘time allowance’.
• • if i see a project is getting bigger than originally planned, i will reach out to you and let you know. you will not incur fees or other payments because i cannot control the stylus.

• Feedback, etc & Final work

• progress images will be shared sporadically once sketching has begun.
• images will always come with a watermark in the form of .jpg or .png
• watermarks will not have a lower opacity when on preview images.
• it is completely on you, as the client, to give polite and constructive feedback.
• i am not responsible for unsatisfactory elements in the final design if no feedback was ever given.
• you are free to request progress reports whenever you’d like but i, as the artist, have the right to refuse or ignore if i am preoccupied or it is outside of my business hours.
• you may only ask for one (1) singular revision of the overall composition of the artwork if something seems off.
• overall : you have five to six (5-6) chances to revise with feedback.
• a lack of respect for artistic styling, skill, or reduction of artistic quality will lead to a cancellation with no refund and no project exchange.
• you are responsible for saving information, images, or other digital data i provide. any file you paid for will be available from me indefinitely.
• if you for some reason lose the file and need a replacement, you can message me and pay a small ‘replacement fee’. i will try to my utmost ability to preserve all my projects big or small.
• at no point will you ever receive a .PSD file from a commission unless agreed upon. this is subject to watermarks and fees.

• public posts & comments

• this is 100% part of your contractual obligation and commission.
• you are responsible for curating your comments and posts about projects on your own social media platforms.
• rude, inappropriate, and/or inflammatory comments are forbidden.
• i reserve the right to defend myself and/or block freely.
• feedback from client to artist is to be through private messages only.
• publicly ridiculing, mocking, or insulting me or my art will result in being blacklisted publicly.
• if you post my artwork to social media you are required to link credit back to me.
• i have a right to know where my artwork will be posted. if you plan to post it on lesser-known sites, please let me know.
• you may not post my artwork on TikTok, Youtube, or Meta owned social media apps without express permission.
• these are subject to change without notice due to new and emerging social media.

a small about me :
══ i come from a small town in louisiana. i took art all four years of high school and was that kid that asked for art supplies for christmas.
══ as a millennial, i grew up watching old school anime like dragon ball, sailor moon, gundam, and various others. my style is inspired by these animes.
══ on a personal note : art is my way to express myself. it is an outlet for me.
══ art is not the only thing i do in my spare time. i also dabble in graphic design, embroidery, and custom dolls. i also love to write and wish to one day write my own book.
